Alabama House Bill to give Road Contractors Immunity

Members of the Alabama House of Representatives seek to introduce HB 382 which would give total civil immunity to road contractors working on state projects within the specifications of the contract. If passed, this bill would provide that a contractor performing highway, road, or street repairs, construction or maintenance is not liable for damage or injury resulting therefrom despite the existence of negligence or notice of a dangerous condtion.

Last Friday, a Bullock County jury returned a verdict in the amount of $10 million for the Plaintiff, represented by Taylor & Taylor, against APAC, the Defendant road contractor. Attorneys for the Plaintiff proved that APAC created a dangerous "dip" on Highway 110 near Fitzpatrick Aalabama, APAC knew of the dangerous condition from other similar incidents, APAC did not fix the condition, and ultimately caused a wreck whereby Plaintiff's decedant was killed. Attorneys for Plaintiff argued against APAC's position that a dangerous condition did not exist and ultimately proved the condition did exist and was repaired soon after the fatal crash; despite APAC's continued denial throughout the trial of any subsequent repairs.

If HB 382 passes into law, egregious corporate conduct by road contractors will continue unfettered, placing the public at risk on the roadway.

Originally posted at InjuryBoard by Tedford Taylor

Jury Awards $6.5 Million to Crash Victim

Last week, a Florida jury awarded several million dollars to a plaintiff who suffered brain injuries in a two car accident. According to the Herald Tribune, the injured man did not immediately seek medical treatment for his brain injuries because he did not appreciate the extent of them at the time. The brain injury affected the victims ability to earn income and his behavior. In addition, the crash victim suffered a back injury that will require further surgery and therapy for the rest of his life.

Originally posted at InjuryBoard by Gregory Zarzaur

Police Investigating Hit-and-Run Accident

Former Auburn student was involved in a hit-and-run accident on South College Street on Sunday morning.

Erin Klein, 22, was leaving Bodega with her boyfriend Cory Kuczynski and their friends when Klein was hit crossing College Street while making her way to her car, that was parked behind Mellow Mushroom.

"I was walking back to my car across the street and as soon as I turned back around, I heard her get hit by the car," said Kuczynski. "She rolled up on the hood and fell of the side of the car."

Kuzynski and other bystanders rushed over to Klein to make sure she was okay and found her breathing but unresponsive.

Klein was taken to East Alabama Medical Center and put in ICU and has since stabilized. She has a broken collar bone, several staples in the head and many other injuries including a possible torn ligament in her right leg.

A police report filed in the case describes the vehicle as a silver Toyota Tacoma with Georgia tags. A Toyota emblem on the ground near the scene assured investigators of the make of the truck.

The report also said the truck would likely have front-end damage. Kuczynski said the driver of the truck left immediately after the incident, but not before briefly slowing. "It slowed down enough to realize what happened and then sped off," Kuczynski said.

Originally posted at InjuryBoard by Christina Cole

Glen Davis in Car Accident

Hours after LSU's 66-49 victory over Connecticut - Glen Davis, Tiger forward, was involved in a car accident early Sunday morning and taken to Baton Rouge Hospital.

LSU coach John Brady said Davis was released from the hospital Sunday morning and would be able to participate in a no-contact walkthrough Sunday night to prepare for LSU's Southeastern Conference opener in Alabama on Tuesday night.

"Davis is a little sore and banged up, but he should be ready to play by Tuesday," Brady said. "He was very lucky."

Davis left the Pete Maravich Assembly Center late Saturday and was driving to get something to eat when his car was broadsided by another driver who apparently ran a stop sign. The impact was severe enough to trigger Davis driver-side air bag. Davis was alone in the vehicle, said Brady.

Davis, who turned 21 on New Year's Day, was put through a series of tests, X-rays and a CAT scan, none that revealed serious damage. Doctors told Brady that Davis's right side, ribs and knees will be sore. Just like anyone else who is jostled around in an accident. Davis biggest concern, Brady said, was making sure he could play Tuesday when the No. 14 Tigers travel to Tuscaloosa to face eighth-ranked Alabama.

Originally posted at InjuryBoard by Christina Cole

Fog Causes 3 Car Accident

The dense early morning fog was a trigger in a three car accident.

Archer County Sheriff Ed Daniels says that a large truck was traveling north on the highway and the driver was unable to see the stop sign up ahead until it was too late to stop. When he crossed through the intersection he crashed with a Ford F-350 pickup. The crash caused the larger truck to roll over and hit into a car parked on the side of the road.

One man was taken by ambulance to the hospital. No word on his condition yet.

Originally posted at InjuryBoard by Christina Cole

Car Involved in Bus Accident May Have Had Mechanical Problem

A malfunction in the steering system of the car involved in a devastating school bus crash last week in Huntsville may have been a contributing factor in the accident said an official from the National Transportation Safety Board on Monday.

The investigator in charge, Gary Van Etten for the NTSB, said the 1990 Toyota Celica that crashed into the bus that was transporting Lee High Students to technical classes may have had a "mechanical problem."

Police have said that the 17-year-old car driver, also a Lee High student, has been receiving death threats. While the investigation is ongoing the teen's name will not be released but his parents are taking precautions to protect him.

"A fourth Lee High School student, 17-year-old Crystalle Renee McCrary, was laid to rest om Monday. Three others students were also killed when the school bus plunged off an I-565 overpass and fell nearly 30-feet to the street below.

Services were held for them Friday and Saturday. Two students, and the bus driver, Anthony Scott, remain hospitalized. Van Etten said Scott was ejected from the bus before it went over the edge of the overpass."

Originally posted at InjuryBoard by Christina Cole
