A comment on Won Your Workers Compensation Case? Not so Fast

They do this in Virginia also. Does Alabama have "Bad Faith Claims handling" laws such that your client could sue the insurance company ? Florida has laws that allow for lawsuits to be successfully brought against the workers compensation insurance company. Unfortunately, Virginia has almost no "bad faith" insurance law, so the comp carriers get away with all sorts of nefarious activities. Keep up the good fight.

I agree. I am going to file something in this case. I don't know what, but something. This practice has got to stop. It is a total abuse of the system. They talk about frivolous lawsuits. What about this frivolous action?

A comment on Homicides Predict Traffic Deaths

I don't know how you are interpreting "aggression", but the way I see it is being in a hurry, speeding, failing to pay attention because you are trying to do too much, etc. More of a Type A situation.

A comment on Homicides Predict Traffic Deaths

Interesting study, although I don't see the aggression in the wrongful death cases we handle. I guess speed does come into play, but that seems broad. I would be interested in knowing more about the connection. Maybe there are more questions to be asked of defendants.

A comment on Mis-filled prescriptions can have deadly consequences

Mike, I had an experience with this kind of accident waiting to happen. My heart doctor has my medical records on line and when I need a refill she could just send the information to the drug store by clicking on send and the prescription was done. The only thing is the drug amount had been decreased but the record showed the full strength Megs. To be able to make sure the drug is the right dose. The whole prescription had to be rewritten. If this was not done or noted at the time of person who was programing the drug to the drug company there could be a problem. It is wise to check all your prescriptions when you get them. Mistakes do happen and no one is aware of how it happened.

A comment on Mis-filled prescriptions can have deadly consequences

I had read here that it takes 4 mistakes for a prescription to be missed, that really does seem like a lot of errors. It, as you say, thankfully doesn't have a lot of effect, but when it does they are deadly.

A comment on Non-Solicitation of Cases - Is it ever going to be enforced?

You make some very good points. We have had all sorts of examples of ads being questioned or firm names being policed, but very little effort to really look at solicitation. Minnesota did solve one issue by making all statement of injured persons presumptively fraudulent to prevent the hospital statements, but more needs to be done to look at this issue.

A comment on Males Die More Than Females

Jon: Your post reminds me of my mother. As a youngster when we'd drive by a cemetery, my mother would ask a question: "Steve, how many do you think are dead?" I'd twist my head around, quickly surveyed the size of the cemetery and would venture a guess. "300!". She'd answer, "No, I'm pretty sure they are all dead." You gotta love a good old New England upbringing.
